Mbarara high court has finally bowed to public pressure and has recalled the execution attachment orders to sale Kabagarame Pork Market.
Amos Kwizera the deputy Registrar Mbarara high court wrote recalling warrants for execution to attach Ishaka Bushenyi Municipality properties over a court case the latter lost to one business man Manfred Muhumuza.
Last week about 2000 people marched from Kabagarame market to town a distance of about 2 km with their local leaders and presented a petition to the RDC and area Mp for onward presentation to the President for intervention.
The matter was also presented to parliament for immediate action lest thousands of people would be deprived on their livelihood.
The weekend pork market is popular for locals and other revelers from far and wide.
According to the letter dated August 29, being addressed to Lauben Tayebwa of Best associates and auctioneers, cancels the former execution warrants for attachment, sale and give vacant possession of Kabagarame land and other municipal properties.
“I write to recall with immediate effect the two warrants issued to you in respect of the Ishaka-Bushenyi municipality properties both for attachment, sale and to give vacant possession respectively “The letter partly reads.
It adds, “This recall has been prompted by a complaint lodged by counsel for the defendant which complaint shall be addressed in presence of parties and their advocates when the matter is scheduled for mention before the deputy registrar.”
It should be noted that Business man Manfred Muhumuza won a case against Ishaka Bushenyi Municipality over the ownership of Ishaka taxi park and was awarded costs of 185m plus compensation which totals to over shs2bn.
When Municipal council defaulted, Muhumuza rushed to court and secured execution warrants to attach and sale properties owned by Municipality in a period of 30 days. This has now been recalled.
Apollo Kakonge one of the people leading the #SaveKabagarame campaign noted that the two parties met at court last week and court ordered that by October 1, Municipality should have come up with means on how it is going to pay one Muhumuza, that attaching Kabagarame land was set aside and should remain un interrupted.
